This Policy applies to the services offered by XTRM, including any XTRM - branded URL, the XTRM email, and any other features, content, or applications offered from time to time by XTRM in connection with XTRM.com(collectively, the "Services"). The XTRM Services are hosted in the United States.
From time to time we may modify this Policy to reflect industry initiatives or changes in the law, our collection and use of personal information, the features of the Services, or technology, and such modifications shall be effective upon posting by XTRM on XTRM.com. Your continued use of the Services after we post a revised Policy signifies your acceptance of the revised Policy. It is therefore important that you review this Policy regularly to ensure you are updated as to any changes. If we materially change our practices regarding collection or use of your personal information, your personal information will continue to be governed by the Policy under which it was collected unless you have been provided notice of, and have not objected to, the change.
When you register to use the Services offered on our Site you voluntarily give XTRM certain personal information, such as your name, street address, phone number, birthdate and email address as well as in some cases financial qualification and billing information including Tax ID or SSN, billing name and address, credit card number, and, for business customers, Tax ID, company name, and the number of users within the organization that will be using the Service. You can update or remove your personal information at any time by logging into XTRM.com and editing your Profile within the Profile tab. You can view your updated profile to confirm your edits have been made.
XTRM, Inc. uses the information that you voluntarily provide to us to set up and provide the Service for individuals and companies. We may also use the information to contact you to further discuss your interest in our company, the Service that we provide, and to send information regarding our company or partners, such as promotions. You may be invited to elect to receive email newsletters from time to time by providing an email address. We will not distribute or share your email address or any other personal information with third parties, if you have elected to keep such information confidential. Unless we explicitly state at the time you voluntarily provide information to us, we will not disclose such information to third parties. All financial (including tax identification numbers and social security numbers) and billing information that you provide to us through XTRM.com will be used only to check your qualifications, to bill for the Service, and, if you are a user receiving taxable payouts, for preparation and distribution of required tax information. We will not use this financial and billing information for marketing or promotional purposes. XTRM uses a third-party intermediary to manage the credit card processing. This intermediary is solely a link in the distribution chain, and is not permitted to store, retain, or use the information provided, except for the sole purpose of credit card processing. Other third parties, such as content providers, may provide content on XTRM.com but they are not permitted to collect any information, nor do we share user information with these parties. Some customers of the Service will be using XTRM.com to host data and information ("Data"). XTRM will not review, share, distribute, print, or reference any such Data except where (i) the customer has elected to permit sharing and/or distribution of such information, (ii) individual records need to be viewed or accessed for the purpose of resolving a problem, support issue, or as may be required by law.. Of course, customers are also responsible for maintaining the confidentiality and security of their user registration and password. In addition, we collect other information including IP address, aggregate user data, volume statistics and browser type. This data is used to manage and improve the Services, track usage, and for security purposes.
You may choose to provide or store certain information in your profiles, including, but not limited to date of birth, interests, groups with whom you are affiliated, videos and/or pictures, private messages, bulletins or personal statements (collectively "Profile Information"). The Profile Information in your profile is provided at your sole discretion. You can change your registration information and Profile Information at any time and can control how others communicate with you by controlling your account settings, available within the "Email Notifications" tab within your Account. If you use our referral service for informing a friend about XTRM.com, we will ask you for your friend's name and email address. XTRM will automatically send your friend a one-time email inviting them to visit XTRM.com. XTRM does not store this information.
Collected Information from Children
We respect the privacy of children and do not collect any more personal information than reasonably necessary to enable them to participate in the Services we offer at our Site. Prior to collecting any personal information from children, we provide parents with direct notice of our information practices and obtain verifiable parental consent by requiring a parent to use a valid credit card to verify their consent.
We collect the following types of personal information directly from children (under the age of 13) online: e-mail address; first and last name; home or physical address including street name and name of a town; telephone number; birth date; other identifier that permits physical or online contact; and an identifier such as a customer number held in a cookie, as well as the aforementioned information we request from all customers as described in this Policy.
Please note that parents may consent to the above collection and use without necessarily consenting to the disclosure of personal information to third parties.
We do not have any agreements with outside organizations to collect personal information at our Site.
Use and Sharing of Children's Information
The information we collect from children is used for fulfillment of a requested transaction; We do not share children's personal information with anyone other than those who provide support for the internal operations of XTRM.com and our agents (e.g., contractors who provide fulfillment services or technical support to XTRM.com). All third parties with whom we share information have agreed to maintain security and integrity of personal information.
Parents can review the information that we have collected from their children online, prevent the further use or maintenance of such information, or direct the deletion of their children's personal information by e-mailing us at the email address provided below.
When you interact with XTRM.com we strive to make that experience easy and meaningful. When you come to XTRM.com, our Web server sends a cookie to your computer. Cookies are files that Web browsers place on a computer's hard drive and are used to tell us whether customers and visitors have visited XTRM.com previously.Standing alone, cookies do not identify you personally. XTRM.com contains links to other web sites. XTRM is not responsible for the privacy practices or the content of these other web sites. It is your responsibility to keep such information private and confidential.
XTRM offers you a means to choose how we may share your information. If, at any time after registering for information or ordering the Service, you change your mind about receiving information from us or about sharing your information with third party, send us a request specifying your new choice. Simply send your request to firstname.lastname@example.org. We will send you an email to let you know when the changes will take effect.
Correcting & Updating Your Information
If you need to update or change registration information you may do so by editing your Account information and/or Profile. To update a User or Organization Profile, including billing information, log on to XTRM and select Profile to update information. You can also email email@example.com or call 1.866.367.9289. XTRM will respond to your correction or update request within at most 30 days from the date of your request.
